Section 8 Contract Administration - Special Claims
A special claim is a request by a property owner for reimbursement of losses due to tenant damages, unpaid rent, or vacancy that exceed the limited security deposits allowed by HUD to be collected by the owner.
The following types of special claims are processed by THDA:
- Vacancy Claim - A special claim to assist owners who have sustained a loss of rental income on vacant units for circumstances beyond their control.
- Damages Claim - A special claim to assist owners who have sustained unnecessary expenses due to extraordinary tenant damage to a vacated unit beyond normal wear and tear.
- Unpaid Rent Claim - A special claim to assist owners who have sustained a loss of rental income on vacated units due to the tenant not paying the full amount of rent due under the lease.
- Rent-Up Claim - A special claim to assist owners of newly subsidized properties who have sustained a loss of rental income on unleased units during the initial lease-up period.
- Debt Service Claim - A special claim to assist owners who have sustained a loss of rental income that resulted in the owner’s inability to meet their financial obligations on their FHA-Insured or HUD-Held mortgage loan.
